BLACK ROCK FITNESS – TERMS AND CONDITIONS

Terms and Conditions of membership entitle an individual to use of the facilities of Black Rock Fitness (hereinafter called ‘Black Rock) subject to the conditions of their chosen membership package, subscription charges and availability. All members agree to follow the Terms and Conditions upon signing to join Black Rock, and Black Rock reserves the right to change the Terms and Conditions at any time, posting details of such changes on the notice boards located at Reception.

1 Opening Times

a. The facilities are open from 6:30am – 9:00pm Monday to Friday and 8:00am – 8:00pm on weekends/Bank Holidays.

b. Black Rock is closed Christmas Day, Boxing Day, Easter Sunday and New Year’s Day.

c. Black Rock reserves the right to change opening times and hours.

2 Membership Terms

a. All memberships are to be paid by Direct Debit.

b. In the event of a membership being paid monthly by Direct Debit and lapsing for more than one month the member may incur an administration charge and have to reapply for membership.

c. Membership cards will be issued to all adult members and must be presented upon arrival at the club. Any card knowingly being used by a person other than the authorised member may result in cancellation of the authorised user’s membership without a refund of the fees already paid. Charges will be charged for replacement of lost cards.

d. All lost cards must be reported to reception immediately. Membership cards remain the property of Black Rock and must be returned to them upon termination of membership.

e. Memberships are not transferable.

f. All charges are subject to change from time to time. Notice shall be given on the notice boards within reception.

g. Subscriptions are due in advance and may be paid annually or by monthly Direct Debit.

h. Black Rock reserves the right at any time to refuse application for admission, to cancel or suspend the rights of admission of any member or refuse admission for a guest or a member where there are reasonable grounds for doing so.

i. Memberhsips are for 12 months and members cannot cancel their payments during that time.

j. Member’s are responsible for ensuring their guests are aware of and adhere to all rules.

k. All members are to complete a ‘PAR-Q’ Form at reception.

l. Only qualified professionals employed by Black Rock are permitted to coach or train any persons on Black Rock premises.

m. Black Rock reserves the right to amend or replace any rules, membership packages or Terms and Conditions of membership.

n. Members must give written notice to Black Rock of any changes of address.

3 Black Rock Terms

a. Black Rock are entitled, without prior notice, to vary the opening times of the facilities.

b. Black Rock has the right to refuse entry onto the premises of any persons whose behaviour or appearance is deemed unsuitable.

c. It is the members’ responsibility to read information on the notice boards and adhere to any notices displayed.

d. Members must show consideration for one another and Black Rock staff in and around the premises. Profane or abusive language or violence of any nature will not be tolerated and Black Rock reserves the right to cancel membership at its discretion.

e. Appropriate clothing and footwear should be worn at all times.

f. Pets are not permitted on the premises with the exception of dogs for the visually impaired or those hard of hearing.

g. Use of drugs, including performance enhancing substances, is strictly prohibited. Members who appear under the influence of drugs will be asked to leave and their membership will be instantly cancelled without refund. Black Rock reserves the right to confiscate the substances and contact the police.

h. Alcohol may not be brought onto the premises and members who appear under the influence of alcohol may be asked to leave and their membership may be cancelled without refund at Black Rock’s discretion.

i. The use of any facilities is strictly prohibited whilst under the influence of alcohol.

j. Smoking and/or vaping is only permitted outside.

k. Cameras, video cameras and camera phones must be not used on the premises without the written permission of a Black Rock Manager. Under no circumstances are cameras, video cameras or camera phones to be taken into changing areas.

l. Black Rock reserves the right to exclusively book areas private parties, tournaments and other activities, notices will be at reception.

m. Each member accepts that they enter into any activity and use the facilities and the equipment of Black Rock entirely at their own risk and they will not hold Black Rock, its health and fitness specialists, instructors or other employees, servants or agents free from all damages, claims or liabilities resulting from, but not limited to, injury or death incurred, or arising from any activity undertaken at Black Rock premises.

n. Black Rock take no responsibility for the loss of any items or money or personal of members or guests, however caused. All items of personal property should be stored in the lockers provided. Members and guests are required to remove all items from lockers at the end of their visit. Black Rock have the right to remove any items left in lockers.

o. All vehicles parked on the premises are done so at members and guests own risk.

p. The pool may be closed for private bookings, details of which will be displayed in reception.

q. All payments for memberships, training sessions or retail products are to be made at reception.

r. The premises may at any time close, without notice, to allow Black Rock to carry out repairs, decorations or other works which can only be carried out whilst the premises are empty.

s. Black Rock reserve the right to refuse access to any member or guest who owe them monies until such a time the accounts are settled in cleared funds.
t. No item of Black Rock property is to be removed from the premises unless agreed with management prior.

u. Fees for guests are charged in addition to membership charges. Guests must be accompanied at all times.

r. Members are required to wipe down all equipment after use ready for the next user using the antibacterial sprays provided. All equipment is to be put away once used by members.

s. No food is to be consumed within the gym, pool, showers, steam room and sauna areas.

5 Under 15’s

a. Any person under 15 years of age must be accompanied by an adult in all areas of the premises and at all times unless attending a class.

b. Any person under 15 years of age is not permitted to use the pool unsupervised by an adult.

c. The gym, sauna and steam room is not to be used by anyone under the age of 15.

d. An adult must take responsibility for anyone under the age of 15, including their behaviour, at all times whilst they are on the premises.

e. Black Rock reserve the right to suspend or cancel the membership of any family who’s child abuses their rules.

6 Booking Classes/Personal Training Sessions

a. Bookings for classes and personal training session can be made up to seven days in advance.

b. Bookings can be cancelled more than 24 hours prior to booking times without penalty. A charge of £10 per class and £15 per personal training session will be applied for cancellations made less than 24 hours to booking time.

c. Members must arrive for classes at least 10 minutes before start time and 5 minutes before personal training session. Please be advised that Black Rock cannot guarantee admittance to classes or the full personal training session time if a member is late.

8 Memberships

a. Membership package details are available from Reception.

b. Black Rock the right to amend membership packages and to increase membership subscriptions from time to time without notice.

c. Should a member become injured or unwell, it may be possible to freeze to their membership, for a maximum period of 3 months, if a written request is submitted along with supporting documentation from your GP/Specialist.

d. Black Rock reserve the right to demand payment of any remaining contract in full should a member miss a monthly payment which then remains outstanding for 21 days after the due date.

e. Guest day rates can only be used on the day of purchase.

9 Corporate Membership

a. Proof of employment is required.

b. Should a member leave employment and no longer be entitled to corporate rate, they must inform Black Rock in writing within 7 days of the change in circumstance. The member will then be charged at standard rate for the remainder of their contract.

c. Failure to inform Black Rock of any change may result in the member being refused entry or their membership suspended.
10 Refunds

a. Any member can cancel their membership within the first 7 days of taking their membership without penalty. A full refund shall be given. If not cancelled within this time the member is liable for the cost of the full 12 month contract.

b. Members care entitled to a full refund on any retail product returned within 28 days of purchase if the product is sealed and unused. Black Rock regret they are unable to refund any product if the seal is broken or the product has been used. Proof of purchase required.

c. Members can return any faulty property for an exchange with 49 days of purchase. Should a replacement item not be in stock the member shall have the option to have a full refund or wait until the item is available again.

Any member who breaches these Terms and Conditions will have their membership suspended or cancelled by Black Rock Fitness.
